Equality duties in Scotland

  • The Equality Act 2010 applies in Scotland, including the Public Sector Equality Duty.
  • Scottish public authorities have their own specific duties, including assessing and reviewing the equality impact of new and revised policies and practices.
  • The Fairer Scotland Duty, in force since April 2018, requires certain public bodies to consider how to reduce inequalities of outcome caused by socio-economic disadvantage when making strategic decisions.
  • The Hate Crime and Public Order (Scotland) Act 2021 came into force in April 2024.
  • The Race Equality Framework for Scotland sets long-term ambitions for race equality, and Gaelic has official status under the Gaelic Language (Scotland) Act 2005.
